Projustice.id – Jakarta, Menurut pandangan tradisional, ilmu hukum dogmatik adalah ilmu hukum in optima forma (dalam bentuk yang optimal). Ia dapat juga kita namakan “Dogmatika Hukum” (Bahasa Jerman: “Rechtsdogmatik“, “Jurisprudenz“).

Dengan istilah ini dicakup semua kegiatan ilmiah yang diarahkan untuk mempelajari isi dari sebuah tatanan hukum positif yang konkret. Sifat “dogmatikal”nya itu terletak dalam hal bahwa orang sungguh-sungguh membatasi diri pada satu sistem hukum spesifik. Orang membatasi diri pada kaidah-kaidah hukum positif tertentu, dan menutup diri terhadap sistem-sistem hukum yang lain.

Sementara itu orang menemukan dalam kepustakaan berbagai pendekatan yang berbeda dari dogmatika hukum. Hal itu banyak tergantung pada bagaimana orang memandang sifat khas dari hukum positif itu (jadi, objeknya). Jika orang menonjolkan sifat normatif dari objeknya itu (sebagaimana misalnya dilakukan Kelsen), orang akan cenderung untuk memandang ilmu hukum dogmatik sebagai suatu “ilmu normatif”.

Yang lain menunjukkan bahwa tidak hanya objek dari dogmatika hukum terdiri atas gejala-gejala normatif, tetapi bahwa ia (dogmatika hukum itu) sendiri juga menjalankan suatu pengaruh menormai (mengkaidahi, mengugeri, menetapkan keharusan). Jadi, ilmu hukum dogmatik juga memiliki dimensi politik praktikal (F. Mueller, JURISTISHE METHODIK, 1976; H. Ryffel, RECHTS UND STAATSPHILOSOPHIE, 1969).

Itu berarti antara lain bahwa aspek-aspek normatif dan faktual di dalam ilmu hukum berjalan saling menyilang. Pendirian ini di Belanda antara lain oleh Paul Scholten dalam karyanya ALGEMEEN DEEL (1934, 1974) dipaparkan dengan cara yang menyakinkan. Ilmu hukum itu, demikian Scholten menjelaskan, mengenal tidak hanya suatu dimensi memaparkan (beshrijven, deskriptif) tetapi juga suatu dimensi mengkaidahi (voorschrijven, preskriptif). Pemahaman teoretikalnya secara praktikal relevan. Dari sini tampak bahwa dogmatika hukum itu adalah suatu gejala majemuk.

Ilmu hukum dogmatik itu memiliki suatu karakter sendiri, ia adalah sebuah ilmu “sui generis“, yang tidak dapat dibandingkan (diukur, dinilai) dengan bentuk ilmu lain yang mana pun. Ia memiliki berbagai ciri. Kita dapat mengemukakan dan menjelaskan ciri-ciri tersebut sebagai berikut:

a). Pertama-tama, ilmu hukum itu memiliki suatu sifat empirik analitikal. Itu berarti bahwa ia memberikan suatu pemaparan dan analisis tentang isi (dan struktur) dari hukum yang berlaku. Terkait padanya, ia dapat menggunakan metode-metode empirikal, tetapi hal itu tidak perlu. Yang pasti ia tidak memberikan penjelasan (Erklaren), meskipun benar ia memikirkan berbagai pengertian dalam pertautan antara yang satu dengan yang lainnya. Untuk itu pengertian-pengertian ini dianalisis dan terutama dicoba untuk memahami pengertian-pengertian tersebut (memahami “makna” mereka) dengan berlatar belakang asas-asas yang melandasi mereka. Hal itu tidak mengherankan mengingat apa yang sudah kami kemukakan terlebih dahulu tentang pentingnya ide hukum (cita-hukum). Keterkaitan pada asas-asas (hukum) ini terutama dalam kerangka penstudian dan pengembanan hukum perdata adalah eviden (jelas).

b). selanjutnya, ilmu hukum mensistemasi gejala-gejala hukum yang dipaparkan dan dianalisis itu. Itu tidak perse (demi dirinya) mengandung arti bahwa suatu “sistem hukum” yang logikal konsisten telah dirancang, sebagaimana misalnya terjadi dalam pandangan-pandangan dari Luhmann atau Raz (meskipun masing-masing dengan cara yang sangat berbeda). Ia lebih merupakan pengembangan suatu “sistem terbuka”, yang berarti bahwa aturan-aturan dan keputusan-keputusan hukum dipikirkan dalam suatu hubungan yang ralatif bebas antara yang satu dengan yang lainnya. Yang menentukan padanya adalah

Bahwa orang mempertautkan kaidah-kaidah hukum ini pada asas-asas yang melandasi hubungan ini. Dengan latar belakang asas-asas ini, maka gejala-gejala hukum lain juga dapat disistematisasi. Justru di dalam hal itu terletaknya sifat “terbuka” dari pensistematisasian tersebut. Ini adalah tugas dari dogmatika hukum dalam arti sempit.

Sementara itu, pensistematisasian ini tidak sama penting pada semua bagian dari hukum. Untuk hukum perdata (dan dalam derajat yang lebih kurang untuk hukum pidana) ia memiliki arti lebih besar ketimbang misalnya untuk hukum tata negara. Adanya peradilan mempunyai pengaruh yang besar. Suatu yurisprudensi yang terolah, sebagaimana yang kita kenal dalam hukum perdata, berdaya stimulatif untuk pemekaran suatu dogmatika hukum.

Jika yurisprudensi sama sekali tidak ada, maka terdapat bahaya bahwa ilmu hukum hanya merupakan hal mengungkapkan penataan-penataan dan struktur-struktur yang ada (misalnya tatanan negara).

c). Ilmu hukum menginterpretasi hukum yang berlaku. Bukankah deskripsi (pemaparan), analisis, dan sistematisasi hukum yang berlaku mengandaikan bahwa arti dari hukum ini terlebih dahulu sekurang-kurangnya dalam arti sementara sudah ditetapkan. Lebih dari itu, kegiatan-kegiatan ini terarah untuk mengartikulasi lebih jauh arti ini. Dalam segi ini, ilmu hukum memiliki suatu sifat hermeneutikal. Itu berarti bahwa disini terdapat suatu relasi dengan apa yang dinamakan ilmu-ilmu rohani (Geisteswissenchaften).

d). Ilmu hukum itu menilai hukum yang berlaku. Dalam arti ini ia relatif bersifat normatif. Itu mengandung arti tidak hanya bahwa objeknya terdiri atas kaidah-kaidah, tetapi terutama bahwa pendirian-pendirian, yang ia sendiri ambil, memiliki suatu dimensi pengkaidahan (menetapkan norma). Jadi, dogmatika hukum tidak bebas nilai. Ia secara langsung berkaitan dengan ide hukum (cita-hukum), dengan perwujudan “tujuan” hukum.

Ilmu hukum dogmatik itu dalam penilaian-penilaian dan keputusan-keputusannya mau memberikan sumbangan pada realisasi dari tujuan ini, yakni keadilan atau kebebasan. Darinya ia melandasi semua kegiatannya. Bahwa penilaian ini sungguh-sungguh ada, dapat dikonstatasi dalam semua buku teks atau buku pelajaran (handbook). Juga dari anotasi-anotasi pada vonis-vonis hal ini tampak dengan jelas. Tetapi penilaian terhadap hukum positif mengandaikan suatu kriterium, suatu titik tolak kritikal. Jika orang merenungkannya ia dengan sendirinya akan sampai pada ide hukum atau cita-cita hukum, sebagai dasar dari semua hukum.

e). Ciri yang terakhir berkaitan dengan arti praktikal dari ilmu hukum dogmatik. Ini berkaitan erat dengan dimensi normatif yang baru saja dibicarakan. Antara teori dan praktik berkenaan dengan dogmatika hukum terdapat perkaitan-perkaitan yang majemuk (rumit, jelimet).

Apa yang dikemukakan oleh ilmu hukum dogmatik pada akhirnya berkaitan dengan penerapan hukum secara praktikal. Untuk itu hukum dipaparkan, dianalisis, disistematisasi, dan diinterpretasi. Pada penerapan praktikal itulah juga penilaian normatif terhadap hukum positif diarahkan.

Pada tataran teoritikal, ilmu hukum dogmatik itu memberikan (menyediakan) suatu model bagi perwujudan hukum secara praktikal (dan dengan demikian “tujuan” dari hukum). Model ini direfleksi dan diargumentasi secara teoretikal. Sebagai demikian, jadi sebagai model teoretikal, ia relevan secara praktikal. Bukankah praksis hukum itu berorientasi pada model ini. Tanpa pegangan (bimbingan) teoretikal ini, praktik tersebut (misalnya peradilan, advokatur, perundang-undangan) tidak dapat berfungsi. Pada pihak lain, isi dari praktik hukum memberikan dampak balik pada model teoretikal ini; bukankah teori itu merefleksi praktik hukum itu dan karena itu harus memperhitungkannya.

Jadi, teori dan praktik itu saling berkaitan erat, dan karena itu juga hanya dapat dipikirkan sebagai suatu keseluruhan (teoretikal) dan diwujudkan (secara praktikal). Teori memikirkan hubungan teori praksis dan praktik merealisasi hubungan teori praksis. Disini letak dari makna normatif praktikal dari dogmatika hukum. Berdasarkan itu juga, maka pandangan empirik yang murni dari ilmu hukum harus ditolak. Bukankah didalamnya teori dan praktik (penerapan praktikal) yang satu dari yang lainnya dipisahkan secara tajam. Pemisahan ini sungguh tidak bermakna, sebab ia menyangkal (keliru memahami) sifat khas, yang tipikal dari ilmu hukum dogmatik. Pemisahan itu berarti tidak mengakui (menghargai) karya dalam teori dan praktik yang sudah ribuan tahun dijalankan oleh para yuris.

Dari apa yang dikemukakan diatas tampak bahwa dogmatika hukum itu juga memiliki suatu karakter. Dengan itu tidak hanya dimaksudkan bahwa ia menjelaskan momen-momen politik apa yang ikut terlibat dalam teori dan praktik hukum, tetapi terutama juga bahwa ia sendiri menganut suatu pendirian politik (hukum). Ia juga sesungguhnya memainkan suatu peranan pada pemikiran dan perancangan pengaturan perundang-undangan, ia mengkritik yurisprudensi dan memperjuangkan (membela) penyelesaian-penyelesaian untuk kejadian-kejadian individual yang (dapat) dihadapkan kepada hakim. Dengan kata lain, ia langsung berkaitan pada dan melandasi pembentukan hukum dan penemuan hukum dalam kenyataan.

Jadi, dengan “politik” dimaksudkan bahwa dogmatika hukum secara aktif terlibat pada penataan masyarakat (yang paling didambakan). Mungkin saja ia melaksanakan aktivitas politik ini dengan suatu cara yang berbeda ketimbang yang dilakukan oleh partai-partai politik atau oleh para pejabat pemerintahan atau anggota parlemen, tetapi hal ini tidak mengurangi fakta bahwa aktivitas-aktivitasnya seyogyanya dikualifikasi sebagai “politik”.

Dengan itu sekaligus dikatakan bahwa suatu pemisahan secara tajam antara hukum dan politik adalah tidak mungkin. Butir ini di sini tidak dapat dijabarkan lebih lanjut. Kiranya sudah mencukupi pernyataan bahwa hukum itu selalu meripakan resultat dari suatu proses itu sebagai “politikum”. Pada sisi lain, proses politik itu hampir selalu terarah pada pembentukan hukum. Politik dan hukum mewakili (mencerminkan) berturut-turut momen dinamikal dan statistikal dari suatu masyarakat yang sedang mengembangkan diri. Sekarang kita melihat lebih jauh bagaimana pandangan teori hukum empirik tentang sifat (hakikat) dari ilmu hukum.
